PRIVACY POLICY

1) This Privacy Policy sets out the rules for the processing of personal data obtained through the guitarimprovlessons.com website (hereinafter referred to as the “Website”).

2) The owner of the Website and, at the same time, the data controller is Adrián Molina Saura conducting business activity under the name Adrián Molina Music with e-mail: molina.saura.adrian@gmail.com, DNI: 23059632Q, hereinafter referred to as Adrián Molina.

3) Personal data collected by Adrián Molina through the Website are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation), also referred to as GDPR.

4) Adrián Molina takes special care to respect the privacy of visitors to the Website.


§ 1 TYPE OF DATA PROCESSED, PURPOSE AND LEGAL BASIS

1) Adrián Molina collects information on natural persons who interact with the Website, hereinafter referred to collectively as the Clients.

2) Clients’ personal data are collected in the event of:

a) Subscribing to a newsletter (Newsletter), for the purpose of performing a contract the subject of which is a service provided electronically. Legal basis: consent of the data subject (Article 6(1)(a) GDPR);

b) Use of the contact form on the Website for the purpose of responding to enquiries about guitar lessons and related services. Legal basis: necessity to perform the contract for the provision of the contact form service (Article 6(1)(b) GDPR).

3) In the case of using the Newsletter service, the Client provides only his/her e-mail address.

4) In the case of using the contact form, the Client provides the following data:

a) e-mail address;

b) name and surname.

5) When using the Website, additional information may be collected, in particular: the IP address assigned to the Client’s computer or an external IP address of the Internet provider, domain name, browser type, access time, and operating system type.

6) Navigational data may also be collected, including information about links and actions taken on the Website. Legal basis: legitimate interest (Article 6(1)(f) GDPR), consisting in facilitating the use of services provided electronically and improving the functionality of the Website.

7) Providing personal data to Adrián Molina is voluntary; however, failure to provide the data specified in the contact form or newsletter subscription form will prevent the use of those services.


§ 2 TO WHOM IS THE DATA SHARED AND HOW LONG IS IT STORED?

1) Clients’ personal data may be transferred to service providers used by Adrián Molina to operate the Website, including providers of hosting services, email marketing systems, and systems for analysing traffic on the Website. These providers process data either on the instructions of Adrián Molina (processors) or independently determine the purposes and means of processing (controllers).

2) Clients’ personal data is stored as follows:

a) Where the basis for processing is consent, personal data are processed until consent is withdrawn, and thereafter for a period corresponding to the applicable limitation period for any claims — generally six years, or three years for claims related to business activity.

b) Where the basis for processing is the performance of a service (e.g. the contact form service), personal data are processed for as long as necessary to provide the service and thereafter for the applicable limitation period.

3) If a Client subscribes to the Newsletter, Adrián Molina will send electronic messages containing commercial information about guitar lessons, new content, and related services.

4) Navigational data may be used to improve the Website, analyse statistical data, and adapt the Website to Clients’ preferences.

5) Where required by law, Adrián Molina may make personal data available to authorised state authorities.


§ 3 COOKIE MECHANISM AND IP ADDRESS

1) The Website uses small files called cookies, stored on the end device of the visitor if the browser allows it. Cookies usually contain the name of the domain they came from, an expiry date, and a unique identifier.

2) Adrián Molina uses two types of cookies:

a) Session cookies: deleted when the browser session ends or the device is switched off. They do not collect personal data or confidential information.

b) Persistent cookies: stored in the device’s memory until deleted or expired. They do not collect personal data or confidential information.

3) Adrián Molina uses its own cookies to:

a) Analyse and research Website usage, to create anonymous statistics that help improve the structure and content of the Website.

4) Adrián Molina uses external cookies to collect general and anonymous statistical data through Google Analytics (administrator of external cookies: Google Inc., based in the USA).

5) The cookie mechanism does not allow viruses or other malware to enter the Client’s device. Clients may limit or disable cookies in their browser settings; the Website will remain usable, except for functions that require cookies by nature.

6) Adrián Molina may collect IP addresses for diagnosing technical problems, creating statistical analyses, and for security purposes.

7) The Website may contain links to other websites. Adrián Molina is not responsible for the privacy policies of those sites.


§ 4 DATA SUBJECTS’ RIGHTS

1) Right to withdraw consent (Article 7(3) GDPR): The Client may withdraw consent at any time. Withdrawal does not affect the lawfulness of processing carried out before withdrawal, but may prevent continued use of services that rely on consent (e.g. the Newsletter).

2) Right to object (Article 21 GDPR): The Client has the right to object at any time to the processing of personal data based on legitimate interest, including for marketing purposes. Objection in the form of an email unsubscribing from marketing messages will be treated as an objection to profiling for those purposes.

3) Right to erasure (Article 17 GDPR): The Client may request the erasure of all or some personal data, where the data are no longer necessary for the purposes they were collected, consent has been withdrawn, or processing is unlawful, among other grounds. Adrián Molina may retain certain data to establish, assert, or defend legal claims.

4) Right to restrict processing (Article 18 GDPR): The Client may request restriction of processing in cases such as contesting the accuracy of the data or where processing is unlawful.

5) Right of access (Article 15 GDPR): The Client has the right to obtain confirmation as to whether personal data are being processed and, if so, to access those data and related information, and to obtain a copy.

6) Right to rectification (Article 16 GDPR): The Client may request the immediate correction of inaccurate personal data, or completion of incomplete data, by contacting Adrián Molina at the email address in §6.

7) Right to data portability (Article 20 GDPR): The Client may request their personal data in a commonly used, machine-readable format (CSV), and may request that it be sent directly to another controller where technically feasible.

8) Adrián Molina will respond to requests within one month of receipt. If the complexity or number of requests requires more time, the Client will be informed within one month of an extension of up to two additional months.

9) The Client has the right to lodge a complaint with the competent data protection supervisory authority regarding any violation of their rights under the GDPR.


§ 5 SECURITY

1) Adrián Molina provides a secure, encrypted connection (SSL) when personal data are transmitted through the Website.

2) Adrián Molina will never send correspondence requesting login credentials or passwords.


§ 6 CHANGES TO THE PRIVACY POLICY

1) This Privacy Policy may be updated. Clients will be informed of any changes 7 days in advance.
